about the fiscal cliff. he said it was a good day and constructive conversation. he also said mitch mcconnell and harry reid are currently working on a bipartisan agreement to avoid the fiscal cliff. again a reminder, on january 1st, a package of across-the- board spending cuts and tax increases go into effect. the president also issued an ultimatum saying if no bipartisan agreement can be reached, he will ask them to bring it package to the floor for an up or down vote. why does everyone have to wait until the last minute? he called this a self-inflicted political wounds. it is because they could not reach a deal earlier this year. we will have more tonight at 11. now we will lighten the mood a little bit here to talk about the soft shell crab sandwich. that's quite a sad way. it may become the first state sandwich. -- that's quite a segue. in 2008, they pass legislation to make the multi layered cake our state dessert. >> i like the sandwich. indicative ordered to -- an executive order aimed at minimizing damage to new and restructed buildings. they will need to be 2 feet higher t

what is that going to do to the fiscal cliff negotiations? >> right, there are a couple deadli deadlines actually coming up. january 2nd is the last day of the current congress. any bill that's been submitted, especially the bills that have been passed, the deal with the fiscal cliff, those bills would be worthless. they would go into paper and everything would have to start from scratch. the new congress would have to start a bill and start the process from the beginning. now there are some tricks that congress has to try to speed things up when it wants to. so to some degree, it's not that big of a deal. if there was a deal in the offing, january 3rd, enough votes for it, they could get around the hurdles. but i'm glad you brought up the deadlines because another one is tomorrow. unemployment benefits run out tomorrow for 1 million people. not true. the unemployment portion of the fiscal cliff actually hits us tomorrow. and that's when 1 million people are estimated to see unemployment benefits run out. and tomorrow is also the day that the house will return. i know we said that democrats shamed the house into come iing back, but house

closer to a deal with three days away from fiscal cliff. ed henry standing by in the briefing room. what are you hearing? >> senior white house official says the president told the republican leaders he wants up or down vote on the scaled back plan. he said that then the senate leaders jumped in and said they think they can get a bipartisan plan. the president told senators reid and mcconnell, i'm told they have a day or two to getting a deal done. otherwise we're out of time. he wants an up or down vote or the plan. at that point, john boehner was noncommittal and not say if he would bring it up for a vote. said wait until we cross the bridge. we are close to that bridge. president plan has tax cut for middle class and small spending cut to try to stop the equester that -- sequest they're is coming, perhaps but not major spending cut or entitlement reform like republicans are pushing for. they are coming up with a threshold for taxes? $250,000 or $400,000 or less? i'm told that a late sticking point added is the estate tax. as you know, people can shield $5 million from the estate
